APPRAISING THE UNCAC AS A TOOL FOR INTERNATIONAL COOPERATION IN CRIMNAL MATTERS IN NIGERIA

ABSTRACT

In a world where crime suspects cum offenders, proceeds, evidence and instrumentalities of crime frequently change location, character and value, no nation determined to contain criminality can afford to do it alone. There is increasing need for synergy and international cooperation against international or cross-border crimes, state grafts and looting of public treasuries. One of the main instrumentalities for achieving the much-needed cooperation in both international and domestic law enforcement is the United Nations Convention against Corruption (UNCAC). This paper seeks to discuss the concept of international cooperation in criminal matters in relation to the UNCAC. By means of doctrinal approach, the research presents the conceptual framework of international cooperation in criminal matters vis-à-vis the relevant provisions of UNCAC. It is found that though a useful tool for international cooperation towards anti-corruption, UNCAC is seriously challenged and limited, hence the need for supplementary protocol or amendment followed with complementary domestic policies towards the full realization of the noble objectives of this very important treaty in the special interest of Nigeria and the developing world.
